This book addresses the problem of how to make democratically-legitimate public policy on issues of contentious bioethical debate. It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. How should states make public policy on issues where there is ethical disagreement, not only about appropriate outcomes, but even what values are at stake? What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. This book is of interest to policymakers, bioethicists, and philosophers, and will deepen our understanding of the interactions between large-scale socio-political forces and detailed policy problems in bioethics. Ecological psychologists and enactivists agree that the best explanation for a large share of cognition is nonrepresentational in kind. In both ecological psychology and enactivist philosophy, then, the task is to offer an explanans that does not rely on representations. Different theorists within these camps have contrasting notions of what the best kind of nonrepresentational explanation will look like, yet they agree on one central point: instead of focusing solely on factors interior to an agent, an important aspect of cognition (...) is found in the link or coupling between an agent and the external world. This link is fluid, dynamic, and active in a variety of ways, and we do not need to add any internal extra something in the perception-action-cognition process. At the same time, even devout defenders of ecological psychology and enactivism recognize that plenty happens inside an agent during cognition. In particular, no one denies that the brain plays an important role. What, then, is the role of the brain if it’s not in the game of representing the environment? One possible option is to describe the brain as a resonant organ instead of a representational organ. In this paper we consider the history of resonance in more detail. Particular focus will be placed on two different sets of approaches that have developed the concept of resonance: a representational reading of resonance and a nonrepresentational, dynamic account of resonance. We then apply these accounts to a case study on music performance, specifically in the context of standard tonal jazz. From this application, we propose that a nonrepresentational resonance account consistent with both enactivism and ecological psychology is a viable way of explaining jazz performance. We conclude with future considerations on research regarding the brain as a resonant organ. (shrink)

Using a longitudinal case study design, we have tracked the recovery of motor function following severe traumatic brain injury (TBI) through a multimodal neuroimaging approach. In 2006, Canadian Soldier Captain (retired) Trevor Greene (TG) was attacked with an axe to the head while on tour in Afghanistan. TG continues intensive daily rehabilitation, which recently included the integration of physical therapy (PT) with neuromodulation using translingual neurostimulation (TLNS) to facilitate neuroplasticity. Recent findings with PT+TLNS demonstrated that recovery of motor function occurred (...) beyond conventional time limits, currently extending past 14-years post-injury. To investigate whether PT+TLNS similarly resulted in associated cognitive function improvements, we examined event-related potentials (ERPs) with the brain vital signs framework. In parallel with motor function improvements, brain vital signs detected significant increases in basic attention (as measured by P300 response amplitude) and cognitive processing (as measured by contextual N400 response amplitude). These objective cognitive improvements corresponded with TG’s self-reported improvements, including a noteworthy and consistent reduction in ongoing symptoms of post-traumatic stress disorder (PTSD). The findings provide valuable insight into the potential importance of non-invasive neuromodulation in cognitive rehabilitation, in addition to initial indications for physical rehabilitation. In ‘Rational Persuasion as Paternalism', George Tsai argues that providing another person with reasons or evidence can be a morally objectionable form of paternalism. I believe Tsai’s thesis is importantly correct, denying the widely accepted identification of rational persuasion with respectful treatment. In this comment, I disagree about what is centrally wrong with objectionable rational persuasion. Contrary to Tsai, objectionable rational persuasion is not wrong because it undermines the value of an agent’s life. It is wrong because it is contrary (...) to an agent’s will. (shrink)

It is well-known that people will adjust their first-order beliefs based on observations of others. We explore how such adjustments interact with second-order beliefs regarding universalism and relativism in a population. Across a range of simulations, we show that populations where individuals have a tendency toward universalism converge more quickly in coordination problems, and generate higher total payoffs, than do populations where individuals have a tendency toward relativism. Thus, in contexts where coordination is important, belief in universalism is advantageous. However, (...) we also show, across a range of simulations, that universalism will enshrine inequalities and eliminate diversity, and in these cases it seems that relativism has its own advantages. When a symbol is a marker of a primary bearer of value and, secondarily, a bearer of value itself, then it has symbolic value. Philosophers have long been suspicious of symbolic values, often regarding them as illusory or irrelevant. I suggest that arguments against symbolic values either overgeneralize or else require premises that can only be supported if the normative significance of some symbolic considerations is presupposed. Humans need symbols to represent identity facts to themselves and others. Symbolic values thereby (...) contribute to individuals’ control over their own agency. (shrink)

Being open to persuasion can help show respect for an interlocutor. At the same time, open-mindedness about morally objectionable claims can carry moral as well as epistemic risks. Our aim in this paper is to specify when there might be duty to be open to persuasion. We distinguish two possible interpretations of openness. First, openness might refer to a kind of mental state, wherein one is willing to revise or abandon present beliefs. Second, it might refer to a deliberative practice, (...) according to which one is willing to engage with opposing reasons. We suggest these two interpretations are conceptually and empirically distinct. Once disambiguated, we suggest that different contexts may make different forms of openness appropriate as expressions of respect. (shrink)

Exploring the Illusion of Free Will and Moral Responsibility is an edited collection of new essays by an internationally recognized line-up of contributors. It is aimed at readers who wish to explore the philosophical and scientific arguments for free will skepticism and their implications.

This article, which introduces the special section on The Urban Problematic, takes as its starting point the ways in which categories associated with the ‘urban’ have broken down, such that the once singular and coherent concept ‘city’ has disintegrated in certain ways: the notion has been demythologized, so that representations of the city must now be regarded as partial and invested; and cities themselves have become opaque and unpredictable both to urban scholars and to governments, planners and various kinds of (...) welfare organizations. The indications of crisis, captured for instance by concerns about the slums, favelas and shanty towns of the world’s megacities, also indicate that much of what counts in modern urban life is in some way connected with the marginal, the unofficial, and the supplemental. The article takes a supplemental view of the current state of urban dwelling. This involves at the same time a longer, more patient, historical view in its attempt to understand the current state of the city as part of a shift in the play of heterogeneous forces. With reference to the articles contained in The Urban Problematic, this introductory article finally draws attention to some of the urgent and critical issues of contemporary urbanism. (shrink)

Investigating the influence of perception on the control of visually guided action typically involves controlled experimentation within the laboratory setting. When appropriate, however, behavioral research of this nature may benefit from the use of methods that allow for remote data collection outside of the lab. This study tested the feasibility of using remote data collection methods to explore the influence of perceived target size on visually guided cursor movements using the Ebbinghaus illusion. Participants completed the experiment remotely, using the trackpad (...) of their personal laptop computers. The task required participants to click on a single circular target presented at either the left or right side of their screen as quickly and accurately as possible, or to emphasize speed or accuracy. On each trial the target was either surrounded by small or large context circles, or no context circles. Participants’ judgments of the targets’ perceived size were influenced by the illusion, however, the illusion failed to produce differences in click-point accuracy or movement time. Interestingly, the illusion appeared to affect participants’ movement of the cursor toward the target; more directional changes were made when clicking the Perceived Large version of the illusion compared to the Perceived Small version. These results suggest the planning of the cursor movement may have been influenced by the illusion, while later stages of the movement were not, and cursor movements directed toward targets perceived as smaller required less correction compared to targets perceived as larger. Ralph Waldo Emerson is often seen as the early American prophet of autonomy. This essay suggests a perhaps surprising fellow traveler in this prophetic call: Joseph Smith. Smith opposed religious creeds for the same reason that Emerson denounced them, namely that creeds represent a threat to the autonomy of a person's beliefs. Smith and Emerson also forward similar defenses of individual autonomy in action. Furthermore, they encounter a shared problem: how can autonomy be possible in a society where other individuals (...) hold some kind of authority? I propose that each thinker resolves this tension through an insight with a Kantian echo. A suitably qualified version of authority can sometimes count as an expression of, rather than hindrance to, autonomy. I describe the overlap in Emerson and Smith as a “frontier” version of Kantianism. They favor determining one's own beliefs and actions in a way that looks forward to an open future of possibility. Background While prenatal surgery historically was performed exclusively for lethal conditions, today intrauterine surgery is also performed to decrease postnatal disabilities for non-lethal conditions. We sought to describe physicians' attitudes about prenatal surgery for lethal and non-lethal conditions and to elucidate characteristics associated with these attitudes. Methods Survey of 1200 paediatric surgeons, neonatologists and maternal–fetal medicine specialists. Results Of 1176 eligible physicians, 670 responded. In the setting of a lethal condition for which prenatal surgery would likely result in the child (...) surviving with a severe disability, most respondents either disagreed or strongly disagreed that they would recommend the surgery. Male physicians were twice as likely to recommend surgery for the lethal condition, as were physicians who believe that abortion is morally wrong. Older physicians were less likely to recommend surgery. For non-lethal conditions, most respondents agreed that they would recommend prenatal surgery, even if the surgery increases the risk of prematurity or fetal death. Compared with MFMs, surgeons were less likely to recommend such surgery, as were physicians not affiliated with a fetal centre, and physicians who were religious. Conclusion Physician’s attitudes about prenatal surgery relate to physicians’ beliefs about disability as well as demographic, cultural and religious characteristics. Given the variety of views, parents are likely to receive different recommendations from their doctors about the preferable treatment choice. (shrink)

This article commemorates Jean Baudrillard’s career with an account of the consistency of his interventionist logic, the subtlety of his styles of argument and the prescience of his observations. It provides an account of Baudrillard’s sustained engagement with the intensification of simulation that has increasingly codified trends in communications, technology politics, the social, the psychological and economics in the name of functionality. The consistency of Baudrillard’s arguments belies the many superficial judgements made about them, which were anyway often knowingly encouraged (...) by Baudrillard’s rhetorical strategies. (shrink)

In this article we outline the ways in which questions of language have both revealed problems with conceptions of knowledge and suggested constructive ways of addressing those problems. Having examined the limitations of instrumental notions of language, we outline some alternatives, especially those developed from the middle of the 19th and throughout the 20th century. We locate forceful and influential philosophical interventions in the writings of Nietzsche and Heidegger and foundational revisions in the linguistics of Ferdinand de Saussure and his (...) structuralist inheritors. We also chart the parallel path of literary theory from Mallarmé through Blanchot and poststructuralism to deconstruction. We conclude, after making some observations about the politicization of language in the works of feminist and postcolonial theorists, with some remarks about how the question of language helps to problematize global knowledge. The article examines the distinction between the state of emergency and the normal state and an inherent undecidability at the base of the distinction. We argue that states of emergency arise from strategic sovereign decisions to divide visible from invisible, enemy from ally, underground economy from above-ground, illegitimate war from legitimate war. The capacity to so divide is manifested, for instance, in the technology of air raid sirens in a way that indicates the momentum of the technicity that covertly underlies (...) sovereign power. The article, furthermore, shows how the distinction between the visible and the invisible can serve as a mystification, perpetuating the state of emergency by disguising the intrinsic connection between the two domains. This introduction to the special section ‘The Half-Life of the Avant-Garde: 50 Years On from 50 Years On’ explains why the section is conceived to look back at the century since the First World War. It is designed to offer ways of rethinking the concept and the role of the anniversary, where the First World War constitutes the memorialized event. The organization of the section follows the movement between often hidden or submerged forms of continuity. It attempts to think some (...) of the aesthetic and technological legacies and inheritances of the First World War in its durational 100th anniversary through a specific temporal strategy most succinctly captured in the phrase ‘50 years on from 50 years on’. The entry point is the middle of the 20th century, allowing contributors to work backward and forward by examining links between the three separate temporal frames. The consistency but also the strangeness of critical practices, as world history passes with its violent climaxes and depressions, has unique contours in each frame, with Dada providing an exemplary through-line. Violence is spoken of in several senses but its most basic definition, as a force exerted by one thing on another, harbors serious problems, especially when it comes to a consideration of its source or cause. We begin this article by identifying some of the aporias of violence with reference to philosophical and religious discourses and then we go on to analyze how violence problematizes concepts of law and justice in world historical contexts. We examine several traditions including Indo-European mythology, (...) as well as Hindu, Taoist, and ancient Greek philosophy, before addressing the concept of violence in modern thought, as a revision of Christianity. We conclude with some discussion of epistemological violence and its critics. (shrink)

Social egalitarianism holds that individuals ought to have equal power over outcomes within relationships. Egalitarian philosophers have argued for this ideal by appealing to features of political society. This way of grounding the social egalitarian principle renders it dependent on empirical facts about political culture. In particular, egalitarians have argued that social equality matters to citizens in political relationships in a way analogous to the value of equality in a marriage. In this paper, we show how egalitarian philosophers are committed (...) to psychological premises, and then illustrate how to test the social egalitarian’s empirical claims. Using a nationally representative survey experiment, we find that citizens will sometimes prioritize equality over competing values, but that the weight of social equality diminishes when moving from personal to political cases. These findings raise questions for thinking about how to explain the normative significance of social equality. (shrink)

We can imagine agents who would have the moral status to demand contractualist justification but still lack an especially strong claim against interference. In contrast, agents who can conceive of their lives in a temporally unified way have a distinctive, strong interest in non‐interference. This contrast helps illuminate the moral importance of self‐authorship. The upshot is that ordinary persons have a more general and less variable right against interference than is often supposed. A common Christian belief is that God loves universally, and that the Christian believer ought, likewise, to love universally. On standard analyses of love, loving universally appears unwise, morally suspect, or even impossible. This essay seeks to understand how the Christian command to love could be both possible and morally desirable. It considers two scriptural examples: Matthew’s trilogy of parables, and the Feast of the Tabernacles in the Gospel of John. I argue that God shows love to humanity through revealed (...) disclosure of vulnerability. In particular, God is universally willing to engage in collaborative action with human agents. I suggest that the Christian command can be satisfied by adopting an analogous willingness to share intentional actions with others. (shrink)

Corporate governance and finance are dynamic academic fields that offer myriad opportunities for business ethics analysis. Within the corporate governance triad in recent years, shareholders have increased their power over boards of directors and executives through both regulation and movements to change corporate by-laws. The impact of board characteristics on firm performance has proven elusive, leading to questions concerning board processes and individual director beliefs and behaviors. At the same time, CEOs have lost considerable power, leaving many struggling to regain (...) their control and maintain their compensation levels, while others adopt a stewardship approach to their posts. In the field of finance, the recent financial debacle has led to a reexamination of financial regulation and of the fundamental nature and purpose of the industry. Louis Loeb has argued that Hume is pessimistic while Peirce is optimistic about the attainment of fully stable beliefs. In contrast, we argue that Hume was optimistic about such attainment but only if the scope of philosophical investigation is limited to first-order explanatory questions. Further, we argue that Peirce, after reformulating the pragmatic maxim to accommodate the reality of counterfactuals, was pessimistic about such attainment. Finally, we articulate and respond to Peirce's objection that Hume's skeptical arguments in T 1.4.1 and (...) his commitment to common sense indicate that Hume was confused about whether we could have stable beliefs at all.
